Terms of Service

These Terms of Service (“Terms”) govern your use of russellconstructionco.com (the “Site”) and any services provided by Russell Construction Company LLC d/b/a RCC Electric(“RCC Electric,” “we,” “us,” or “our”). By accessing the Site or requesting services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Services
RCC Electric provides residential and commercial electrical contracting services in Tennessee. All work is performed by licensed electricians in accordance with the National Electrical Code (NEC) and applicable state and local codes. Specific project scope, deliverables, pricing, and timelines are governed by a separate written contract or signed work order between RCC Electric and the client. In the event of any conflict between these Terms and a signed project contract, the project contract controls for that engagement.
2. Licensing and Credentials
RCC Electric operates as a licensed, insured, and bonded electrical contractor in the State of Tennessee. License documentation is available upon request prior to the start of any project.
3. Estimates and Pricing
Estimates are provided free of charge and are non-binding until a written contract is signed by both parties. Pricing is based on the scope discussed at the time of estimate and may change if (a) the scope of work changes, (b) site conditions discovered during the work require additional labor or materials, (c) material costs change significantly between the date of the estimate and the date of work, or (d) permit or inspection requirements differ from those assumed at the time of estimate. Any change in price will be communicated to the client in writing and approved before additional work begins.
4. Payment Terms
Payment terms are specified in the individual project contract. For most residential projects, payment is due upon project completion and inspection. For larger projects, staged payments may be required (typically deposit, midpoint, and final). RCC Electric accepts cash, check, and major credit cards. Payments are processed through Square. Past-due balances may accrue a late fee of up to 1.5% per month, or the maximum rate permitted by Tennessee law, whichever is less.
5. Workmanship Warranty
RCC Electric warrants its workmanship for one (1) year from the date of project completion. This warranty covers defects in installation and labor performed by RCC Electric. It does not cover:
- Defects in materials, equipment, or fixtures supplied by manufacturers (covered by manufacturer warranties).
- Damage caused by other contractors, homeowners, tenants, or third parties after our work is complete.
- Damage caused by misuse, neglect, or unauthorized modifications.
- Damage caused by acts of God, including lightning strikes, floods, fire, storms, and power surges from the utility.
- Pre-existing electrical conditions not part of the scope of our work.
Warranty claims must be reported in writing to qr@russellconstructionco.com or by phone at (865) 722-5722 within the warranty period.
6. Client Responsibilities
By engaging RCC Electric, you agree to:
- Provide safe access to the property and the work area during scheduled service hours.
- Disclose any known hazards on the property, including hidden wiring, asbestos, lead paint, or structural concerns.
- Obtain any approvals required by your HOA, landlord, or other third parties before work begins.
- Pay invoices in accordance with the agreed payment terms.
7. Cancellation and Rescheduling
You may cancel or reschedule a scheduled appointment at no charge with at least 24 hours' advance notice. Cancellations within 24 hours of the scheduled appointment may incur a cancellation fee to cover scheduled labor. Material orders placed specifically for a project are non-refundable once ordered.
8. Use of the Website
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Submit false, misleading, or fraudulent information through contact forms.
- Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems.
- Use automated tools (bots, scrapers, harvesters) to access or copy content from the Site without our written permission.
- Interfere with the operation of the Site or the experience of other users.
9. Intellectual Property
All content on this Site, including text, photographs, illustrations, logos, page layouts, and source code, is owned by or licensed to RCC Electric and is protected by copyright, trademark, and other intellectual property laws. You may view and print content for personal, non-commercial use only. Reproduction, redistribution, or use of any content for commercial purposes without our prior written consent is prohibited.
10. Disclaimers
The Site and any general information provided on it are made available “as is” and for informational purposes only. RCC Electric makes no warranties, express or implied, about the completeness, accuracy, reliability, or availability of information on the Site. Electrical-related advice on this Site (including blog posts, FAQs, and service pages) is general in nature and is not a substitute for an on-site assessment by a licensed electrician. Do not attempt electrical work yourself based on information from this Site.
11. Limitation of Liability
To the maximum extent permitted by Tennessee law, RCC Electric's total liability arising out of or related to the Site or any services performed shall not exceed the amount actually paid by the client to RCC Electric for the specific work giving rise to the claim. In no event shall RCC Electric be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of business, or property damage not directly caused by our workmanship.
12. Indemnification
You agree to indemnify, defend, and hold harmless RCC Electric and its owners, employees, and subcontractors from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party rights, or (c) any false or inaccurate information you provided that caused damage during the performance of work.
13. Force Majeure
RCC Electric is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, severe weather, utility outages, government action, labor disputes, supply-chain disruptions, pandemic conditions, or telecommunications failures.
14. Governing Law and Venue
These Terms and any dispute arising out of or related to them or the services we provide are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Knox County, Tennessee, and you consent to the jurisdiction and venue of those courts.
15. Dispute Resolution
Before initiating any formal legal proceeding, the parties agree to attempt to resolve any dispute through good-faith negotiation, and if that fails, through non-binding mediation in Knox County, Tennessee, with a mutually agreed-upon mediator. Each party will bear its own mediation costs and split the mediator's fee equally. If mediation does not resolve the dispute within 60 days, either party may pursue available legal remedies.
16. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement; Assignment
These Terms, together with any signed project contract and our Privacy Policy, constitute the entire agreement between you and RCC Electric regarding use of the Site and our services, and supersede any prior agreements. You may not assign these Terms without our prior written consent. RCC Electric may assign these Terms in connection with a business sale or restructuring.
18. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site or our services after an update constitutes acceptance of the revised Terms.
